France has established a comprehensive regulatory framework for cryptocurrencies and digital assets through the PACTE Act, adopted on May 22, 2019. This framework aims to position France as a leading European hub for crypto activities.
Under the PACTE Act, Digital Asset Service Providers (DASPs) must register with the Financial Markets Authority (Autorité des Marchés Financiers, AMF) if they provide any of the following services: custody of digital assets on behalf of third parties, buying or selling digital assets in legal currency, exchanging digital assets for other digital assets, or operating a digital asset trading platform. Operating without proper registration is punishable by up to two years’ imprisonment and a fine of EUR 30,000.
French law differentiates between various types of digital assets. Tokens represent one or more rights that can be issued, registered, stored, or transferred via a distributed database. Digital currencies are digital representations of value not issued or guaranteed by a central bank, accepted as a medium of exchange, and can be transferred, stored, or exchanged electronically.
Certain DASPs, specifically those involved in crypto-custody and crypto-fiat exchanges, must register with the AMF. Other services, such as crypto-crypto exchanges and trading platforms, will also require mandatory registration. Additionally, DASPs can opt for an additional license from the AMF if they meet specific requirements, which provides further regulatory oversight and potentially greater trust from users.
