
XRP price is trading near $1.07 after the recent market recovery. The token has been range-bound for weeks, but the regulatory debate around the Clarity Act could be the catalyst that determines its next major move.
One analyst, Bird, laid out a compelling case for why XRP is in a unique position regardless of what happens with the Clarity Act.
The Analyst’s Case: XRP Wins Either Way
Bird’s argument is straightforward. If the Clarity Act passes, it is bullish for crypto as a whole. But it is especially bullish for XRP because XRP has already been through years of regulatory scrutiny and has substantially more legal clarity in the US than most digital assets following the Ripple case.
If the Clarity Act does not pass, XRP still has that relative legal advantage while much of the industry continues to face greater regulatory uncertainty. Either way, institutions looking for a digital asset with an established legal framework have a much clearer starting point with XRP than with many other tokens.
Bird also noted that if Congress does not create a new framework, the SEC will continue to play a major role in shaping crypto regulation through enforcement and existing law. The Ripple litigation has already become one of the most significant legal precedents in the industry, so it is likely to remain an important reference point for how digital assets are evaluated in the US.
This is why Bird sees XRP as a strong position regardless of the outcome.

The analyst’s comments came in response to breaking news: the SEC said it is ready to create crypto rules if Congress fails to pass the Clarity Act.
This is significant. The SEC is signaling that it will not wait indefinitely for Congress to act. If the Clarity Act stalls, the agency will step in and create its own regulatory framework.
For XRP, this is a double-edged sword. On one hand, SEC rule-making could provide clarity that is currently missing. On the other hand, the SEC’s approach could be more restrictive than what the industry wants.
But Bird’s point is that XRP is already ahead of the curve. The Ripple case established a legal precedent that gives XRP more clarity than most other tokens. Whether the framework comes from Congress or the SEC, XRP starts from a position of relative strength.

My Opinion on All This
Bird’s logic is sound. XRP has already survived the SEC’s most aggressive enforcement action. The court ruled that secondary-market XRP sales are not securities. That is a legal precedent that cannot be easily reversed.
If the Clarity Act passes, XRP benefits from the regulatory clarity that institutions are waiting for. If it fails, XRP still has the Ripple precedent while other tokens face uncertainty. Either way, institutions have a clearer path to adopt XRP than most other digital assets.
The SEC’s statement is a reminder that the agency is not going away. Whether through legislation or enforcement, regulation is coming. XRP is already positioned for that reality.
