CLARITY Act Stalls: XRP Community Outlines Five Issues Holding Up Crypto Legislation

The CLARITY Act has encountered a huge obstacle in the U.S. Senate, but debate over how to revive the legislation is far from over.

Following the failed procedural vote, an XRP community and software engineer Vincent van Code published a detailed breakdown of five disagreements that could determine whether lawmakers can reach a compromise.

The post argues that disputes over stablecoin rewards, political ethics, regulatory jurisdiction, state consumer protections and financial-crime compliance are preventing Congress from establishing a comprehensive digital-asset framework.

The author believes both parties should accept compromises rather than wait for legislation that satisfies every demand. That is an argument for a particular legislative outcome, however, not an established assessment of what Congress should do.

For XRP investors, the debate matters because the proposed framework could affect the wider market infrastructure used by institutions, exchanges and digital-asset businesses.

Stablecoin Yield and Political Ethics Remain Major Obstacles

The community member identifies stablecoin rewards as one of the central disagreements.

Banks have raised concerns that allowing stablecoin platforms to offer yield could encourage depositors to move money away from traditional accounts. Community banks, in particular, argue that substantial deposit outflows could affect their ability to finance local businesses and households.

Crypto companies and their supporters have countered that restrictions on rewards could limit competition and prevent consumers from accessing new financial products.

The XRP community member proposes temporarily removing passive stablecoin yield provisions from the legislation and reconsidering them after a two- to three-year transition period.

That proposal would defer the dispute rather than resolve it. The scale of potential bank deposit outflows remains uncertain, and the post’s characterization of the economic impact is its author’s assessment.

Political ethics provisions present another obstacle.

Lawmakers have debated restrictions on cryptocurrency businesses and financial interests held by public officials and their families. Disagreements include whether officials should divest existing holdings, place assets in blind trusts and face restrictions covering dependent children.

The community member favors broader divestment requirements and stronger enforcement powers for state attorneys general.

These remain proposed compromises, not provisions that Congress has definitively agreed to enact.

SEC and CFTC Powers Are Another Source of Disagreement

The CLARITY Act also seeks to establish clearer boundaries between the Securities and Exchange Commission and the Commodity Futures Trading Commission.

A central question is when a digital asset should fall under a digital-commodity framework and how decentralization should affect its regulatory treatment.

Critics of some legislative proposals argue that insufficiently demanding decentralization standards could allow issuers to avoid securities-law protections prematurely.

Supporters of a broader CFTC role argue that digital-commodity markets need rules tailored to their structure rather than continued uncertainty over which agency has jurisdiction.

The XRP community member proposes stricter decentralization requirements before projects qualify for the relevant regulatory treatment.

This issue is particularly relevant to XRP because the SEC v. Ripple litigation addressed specific XRP transactions but did not establish a complete regulatory framework for every cryptocurrency, intermediary or future transaction.

State Consumer Protections and DeFi Compliance Complicate the Bill

The post identifies two additional disputes involving enforcement authority and decentralized finance.

The first concerns whether federal cryptocurrency legislation should override certain state-level laws.

Supporters of uniform federal rules argue that businesses need consistent requirements across the country. State officials and consumer-protection advocates have raised concerns that broad federal preemption could limit their ability to pursue misconduct under state law.

The community member proposes treating federal requirements as a minimum standard while preserving state enforcement powers.

The final issue involves anti-money-laundering requirements, sanctions compliance and decentralized finance.

Lawmakers disagree over how obligations should apply to DeFi interfaces, developers and users of self-custody wallets.

The post proposes applying basic identity-verification requirements to certain DeFi front ends while protecting underlying open-source software from obligations intended for financial intermediaries.

The practical difficulty would be determining which entities actually control or operate a financial service and which merely publish software. Any final approach would need to account for existing legal requirements as well as the structure of decentralized protocols.

Why the CLARITY Act Is Still Important for XRP

The failed Senate vote has left the legislation’s future uncertain, but a failed procedural vote is not necessarily the same as permanent legislative defeat.

Lawmakers could attempt to reconsider the measure if negotiations produce sufficient support. However, the remaining legislative calendar and unresolved disagreements create significant obstacles.

For XRP, the importance of the CLARITY Act extends beyond the token’s own legal history.

A comprehensive market framework could affect the regulatory treatment of exchanges, custody providers, institutional trading platforms and other businesses involved in digital assets.

Pro-Ripple attorney Bill Morgan has similarly argued that XRP could benefit from clearer rules across the entire cryptocurrency industry because institutions considering XRP-related services also need confidence in the surrounding market infrastructure.

That remains an interpretation of the legislation’s potential effects, not a guarantee of greater adoption or higher XRP prices.

The XRP community member’s post ultimately illustrates why the legislation has proved difficult to advance: the disagreements concern substantive questions about banking competition, investor protections, government ethics and enforcement authority.
