Richard Heart Is Still Free and Has Advice for Lawyers

Cryptocurrency advocate Richard Heart recently highlighted an important legal technicality regarding the privacy protections afforded to publicly shared information. In a Twitter thread, Heart suggested that lawyers pay close attention to this issue as it relates to digital assets.

Specifically, Heart noted that “things people were planning to publish to the public are protected from search and seizure at a higher level than other things.” This refers to the “prior restraint” doctrine in US law, which limits the government’s powers to censor or prohibit speech and publication before they occur.

Heart went on to advise that “if you don’t tell the person searching or seizing your things that what they’re doing is illegal, they can use their ignorance as a defense.” He cited instances where the US government has paid hundreds of thousands of dollars to individuals as compensation for violating these privacy rules.
